I have

family on the force although I've never been a cop myself. But here's my take on the cop issue:

The PD enforces the law primarily by making arrests. And more often than not, an arrest is made AFTER the crime is committed. Not BEFORE, or even DURING. Yes sometimes that happens too, but not usually. The PD also acts as a deterent too. Now you might think that's not true because of all the crime that you read abut in the newspapers. But believe me, if you were to do away w/your local PD tomorrow, I gaurantee you that within weeks, and possibly even days, the streets would be utter chaos because criminals would know that there's no possibility of any consequences other than vigilante acts.

So my whole point is that even though I'd never suggest that it's wrong to call 911 when you suspect someome attempting to break in your house, I do think that it's unrealistic to expect the PD to protect you from that happening in the first place. There just isn't enough police officers around for that.

That's what Mr. Smith & Wesson, and Mr. Mossberg 12 gauge is for. Now ofcourse lethal force should only be used as a last resort, and to defend your life and/or well being, as well as that of your family. Firearms cannot legally be used to defend your belongings or your property, but when and IF your life is being threatened, then it's unrealistic to hope that a police officer can arrive BEFORE you lose it.

I take no joy in having to state these things, but that's the reality of it.

I have to disagree. People are arrested for a crime a lot of times without probable cause. Of course the crime has been comitted, but the cop does not know that. Here's an example from an old rerun of cops I watched Sunday afternoon......

Cop pulls up on a guy walking through a public park after dark.....

Cop: What are you doing?

Guy: Going home.

Cop: Put your hands on the hood.

Cop: Spread your legs.

(starts to frisk subject)

Cop: What is this I feel?

Guy: What?

Cop: Feels like plastic, inside your pants.

Guy: That's my deodorant.

(cop pulls out a plastic deodorant canister, opens it, and searches it, finds drugs)

Cop: You're now under arrest, posession of drugs!

The cop performed an illegal search. The Supreme Court has ruled the officer can frisk him for dangerous weapons or threats to the officer's safety. The Supreme Court never said the cop can open an obvious deodorant container and look for a crime being comitted. The officer never asked for permission to search the deodorant container. How in the hell cops get these illegal searches through court I will never understand. But, as far as I know, the guy's attorney may have been successful in getting the case thrown out too.

disagreeing w/me. Right? But I don't see where you've explained why. You've just discribed a scenario, where a crime has already been committed, before the suspect was arrested. In this case it was drug possession. So that just backs up my point. The suspect was NOT arrested BEFORE the crime was committed, but after. Right, or wrong?

Depends on whether you agree the cop violated the defendant's civil rights or not. That too is a crime ya know. If you doubt me, just ask Sergeant Stacey Koon or Officer Larry Powell. :)


ps - the defendant was detained and WAS NOT free to leave. So, yes, I think he was technically arrested before the cop knew a crime had been committed. That's what I hate about the TV show COPS, you never know the outcome of the cases. I have seen many episodes where I can gaurantee you the charges were dismissed in court. And I have seen many episodes where I am almost certain lawsuits have later been filed as well.

The point you're

making has nothing to do w/what I'm Talking about. I have no argument w/your point concerning a suspect's rights. My entire point that you've claimed to disagree with had to do w/how unrealistic it would be for someone to expect to be protected by the PD from a crime that would take place on their property. And I was also commenting about how an officer's duty is supposed to be carried out. NOT on how a minority of BAD cops operate. And the latter seems to be what you're talking about.

So you're comparing apples to oranges...........
 
I think you are wong here SHERIFF, and from the Court's point of view, not mine.

I teach search and seizure to CPD recruits, and your beliefs about what is "constitutionally correct" police conduct in any classic Terry "stop and frisk" scenario dates your police service back to 1986.

Been some changes since then SHERIFF, and y'all need to stay up to date on them if y'all still stopin and friskin...

The Terry street search game is played much differently today, however, I'm not going to entertain your arguments on this topic, believe what you wish. I will not discuss this anymore. More important to me here, are topics related to the Marauder.

Got headers, SHERIFF? What gears are you running? Got stat? Chip? Denso's? What's different about your front passenger door? Any vibration issues over 120 MPH? How's your tire wear? Alignment? How about that "chunk" or "creek" we all live with on hard right turns on to unlevel pavement? Are you pestered by the your water closet trunk lid? Any cold start issues? Where is your selling dealer located, and how does your dealer treat your complaints? Are they mod friendly? Any unusual tire wear? I know I already asked this, but that was about front tires. How are your back tires wearing now? Does your sub-woofer rattle? Or, does it sound fuzzy? Do your dash lights flicker? Do you have map pockets? Chrome tranny shifter? Internal gas door release or not? Full sized spare tire or not? Polished spare rim? Sunroof? What are your 60' times? Skidpad? Snow tires?

Ummm...Sorry, I'm outta breath.

I'm not here for Marauder discussions. Just like Crown Victorias, everything about the Marauder has been discussed over and over and over and over and over....... and then again. :)

If I was here for Marauder discussions I would not confine myself to "The Lounge" and "The Storyboard".

That's not what I said...... I said I have no interest in discussing things about the Marauder that have been discussed 346 times already. I am not mechanically minded and know nothing about a camshaft being turned upside down for a 3 horsepower gain or the rearview mirror being ported and polished for a 15 horsepower gain. :)

I meant to say I hang out in non-Marauder-related forums for comaraderie and entertainment.

And since you asked..... the only Crown Victoria sight that has a substancial amount of postings each day is FULL of police impersonators. Ranging in age from 11 years old and up. The "They Thought I Was A Cop" subjects every day made me puke. I prefer not to be there. And.... I asked the then Administrator to ban me one night when they all got mad because I called them first class Police Impersonators. He honored my request

We do welcome you with open arms here Sheriff! As you can tell this site has a much more mature/professional crowd than the others. Plus MM cost a lot more to own then the others too! I do like to hear other's legal opinions on different things. I've worked for the court system for over 6yrs now and I am very clear on one thing, even Judges can have different interpretations on a same law.

Oh yes, it's obvious that there's not a bunch of snot-nosed kiddies here like on most other auto forums, Thank God!

And, yes, even judges disagree amongst themselves on the interpetation of a lot of laws, that's why you see a Supreme Court Decision come down with dissenting votes by some judges. What tickles me most though is when judges interpret a law and dismiss a criminal charge that obviously shouldn't have been placed in the first place, the charges being placed by rookies most of the time. I became a deputy sheriff at age 19, and I knew it all as soon as I pinned a badge to my shirt. Or so I thought. :)
 
Used to happen a Lot with my 96 crown Vic Sport, and sometimes with the MM. Must agree with martyo not a cop and I am over it.
